Environmental Law and Regulations
This is an introductory course to the laws of Canada relating to the protection of the natural environment. It begins with the principles of legal systems generally, and the Canadian system with its Federal framework and the sharing of jurisdiction over the environment between Canada?s Federal and Provincial governments. It looks at the protection of the environment through the assessment of environmental impacts, the establishment of environmental legislation and regulation and examines specific environmental statutes that are significant in Canadian practice today
One subject credit.
Upon successful completion of this subject the student will be able to:
- Differentiate between the federal Parliament and the Provincial legislatures in terms of the constitution, system of government, legal system and the division of powers between the levels.
- Identify where the power is, differentiating between the federal Parliament and the Provincial legislatures, to make laws dealing with the natural environment.
- Illustrate the development of private and public laws that are designed to protect and regulate the environment.
- Describe the role stakeholders play in environmental issues and their relationship to each other.
- Describe environmental assessment process and follow the current changes occurring in the environmental assessment regimes applicable to natural resources and other undertakings at both the federal and provincial levels.
- Discuss the provisions of environmental statutes in effect in Ontario, such as the Canadian Environmental Protection Act, 1997, and the Canadian Environmental Assessment Act, the Environmental Protection Act (Ontario) and the Ontario Water Resources Act.
- Identify the regulatory boards, agencies and tribunals at the Federal, provincial and municipal levels that are responsible for the enforcement of environmental legislation, explaining their operation and procedures.
