Subject Title
Introduction to Canada's Legal System

Subject Description
This subject introduces students to important elements of the Canadian legal system. Topics include an introduction to the nature of law, the sources of law, the legal system, the court system, the legal professions; the Law Society's Rules of Professional Conduct, the Canadian Constitution, the Charter of Rights, and methods of analysis.

Credit Status
This is a credit subject applicable to the Seneca Law Clerk Diploma Program offered through the School of Legal and Public Administration and offered through the Faculty of Continuing Education and Training.

Learning Outcomes
Upon successful completion of this subject the student will be able to:

1. Describe the nature of law as a social institution, including an appreciation of its limits.

2. Describe the components of the common law system and demonstrate an understanding as to how common and civil law systems differ.

3. Demonstrate knowledge of the various sources of common law together with an understanding of how the various sources interact and are applied.

4. Describe the differences between private and public law, procedural and substantive law, and demonstrate a general knowledge of the various fields of law.

5. Identify the structure of the Canadian Court system and an understanding of the jurisdictional boundaries between courts.

6. Describe the adversarial system and alternative dispute resolution methods.

7. Describe how lawyers, law clerks and paralegals are trained and governed.

8. Demonstrate an understanding of the general duty owed to the Law Society and to clients.

9. Demonstrate an understanding of the structure of the Canadian government and how the legal system operates within the federal system of government.

10. Demonstrate knowledge of rights set out in the Charter and the ability to interpret those rights.

11. Demonstrate a substantive knowledge of human rights.

12. Demonstrate the ability to write clearly and grammatically, and in general possess language skills that will allow him/her to function in the legal environment.

13. Demonstrate an attitude of professionalism, as evidenced by an ability to meet deadlines, complete assignments and perform tests and in-class asignments as scheduled.

14. Demonstrate achievement of the following learning outcomes related to essential employability skills:

a. communicate clearly, concisely and correctly in the written, spoken, and visual form that fulfills the purpose and meets the needs of the audience.
b. respond to written, spoken, or visual messages in a manner that ensures effective communication.
c. apply a systematic approach to solve problems.
d. use a variety of thinking skills to anticipate and solve problems.
e. locate, select, organize, and document information using appropriate technology and information systems.
f. analyze, evaluate, and apply relevant information from a variety of sources.
g. show respect for the diverse opinions, values, belief systems, and contributions of others.
h. interact with others in groups or teams in ways that contribute to effective working relationships and the achievement of goals.
i. manage the use of time and other resources to complete projects.
j. take responsibility for one's own actions, decisions, and consequences.

Camera Use and Recordings - Synchronous (Live) Classes
Synchronous (live) classes may be delivered in person, in a Flexible Learning space, or online through a Seneca web conferencing platform such as MS Teams or Zoom. Flexible Learning spaces are equipped with cameras, microphones, monitors and speakers that capture and stream instructor and student interactions, providing an in-person experience for students choosing to study online.

Students joining a live class online may be required to have a working camera in order to participate, or for certain activities (e.g. group work, assessments), and high-speed broadband access (e.g. Cable, DSL) is highly recommended. In the event students encounter circumstances that impact their ability to join the platform with their camera on, they should reach out to the professor to discuss. Live classes may be recorded and made available to students to support access to course content and promote student learning and success.
